These Terms and Conditions ("Terms") govern your use of odysseyherbals.com and any purchase from Odyssey Herbals ("Odyssey Herbals," "we," "us"). By using this website or placing an order, you agree to these Terms and to our Privacy Policy.
1. Age requirement
You must be at least 21 years old to use this website or buy our products. By using the site or ordering, you confirm that you are 21 or older. We may ask for proof of age and may cancel any order if we cannot confirm it.
2. Where we ship
We do not sell or ship kratom products to any state, county, city, or other jurisdiction where their sale or shipment is prohibited. We currently do not ship to: Alabama, Arkansas, California, Connecticut, Indiana, Kansas, Louisiana, Massachusetts, North Dakota, Rhode Island, Tennessee, Utah, Vermont, or Wisconsin (and Kentucky beginning January 1, 2027), or to local areas with kratom bans. Laws change; you are responsible for knowing and following the laws where you live. We may cancel and refund any order we believe would violate applicable law.
3. Product information
Our products are not evaluated by the Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease. Product descriptions are provided for identification only. Keep products out of reach of children and pets. Do not use if you are pregnant or nursing. Consult a healthcare professional before use, especially if you take medication or have a medical condition. This product may cause dependence and opioid-like withdrawal. You assume all risks associated with the use of our products.
4. Orders and pricing
All orders are subject to acceptance and product availability. Prices are in U.S. dollars and may change without notice. We may refuse, limit, or cancel any order, including orders that appear fraudulent, exceed reasonable quantities, or contain pricing errors. If we cancel a paid order, we will refund the amount charged.
5. Payment
We accept credit and debit cards. Payment is processed by our third-party payment processor at checkout.
6. Shipping
Orders ship by USPS or UPS, usually within 1-2 business days. Orders of $100 or more ship free; shipping on other orders is calculated at checkout. Delivery times are estimates and are not guaranteed. Risk of loss passes to you when the carrier receives the package.
7. Returns and refunds
Unopened products may be returned within 30 days of delivery for a refund. Opened or used products cannot be returned for safety reasons. To start a return, email sales@odysseyherbals.com with your order number.
8. Wholesale accounts
Wholesale pricing is available only to approved businesses. The minimum wholesale order is $500. Wholesale buyers are responsible for complying with all laws that apply to their resale of our products, including age restrictions and labeling requirements, in their jurisdictions. We may approve, decline, or end any wholesale account at our discretion.
9. Accounts
You are responsible for keeping access to your email account secure, because we send sign-in codes to it. Notify us promptly at sales@odysseyherbals.com if you believe your account has been used without your permission.
10. Website use
You agree not to misuse the website, including by attempting to interfere with its operation, access it by automated means without permission, or submit false information. All content on the site, including text, logos, and images, belongs to Odyssey Herbals or its licensors and may not be copied without permission.
11. Disclaimer and limitation of liability
The website and products are provided "as is" without warranties of any kind, except those that cannot be excluded by law. To the fullest extent permitted by law, Odyssey Herbals will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.
12. Indemnity
You agree to indemnify and hold Odyssey Herbals harmless from claims arising from your misuse of our products or website or your violation of these Terms or applicable law.
13. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules.
14. Changes
We may update these Terms at any time by posting the revised version on this page with a new effective date. Continued use of the site after changes means you accept them.
